City Council Meeting Provides Updates on Court Cases

Burrowing Owl Habitat and Noise Citation Cases Included in Attorney’s Update

During the June 9 Broomfield City Council Meeting, City and County of Broomfield (CCOB) Attorney Sullivan provided an update on outstanding court cases involving CCOB citations against Extraction Oil and Gas.

Tomorrow morning, Wednesday, June 10, Extraction is finally expected to enter a plea in Municipal Court on its 2018 CCOB citation charging that Extraction’s bulldozer drove over a burrowing owl habitat. The matter is set for trial in Municipal Court on July 9 and 10, 2020.

In addition, CCOB is working with Extraction’s attorney to set an arraignment date in late June or early July for Extraction’s noise citations. Based on citizen complaints and acting on behalf of residents, the CCOB had filed a motion in Broomfield Municipal Court on February 11, 2020. The motion sought to have the court intervene and address immediate compliance with the emergency noise ordinance which was effective beginning January 22, 2020.
