“Boulder County Commissioners, Lafayette file lawsuit against COGCC, oil and gas company”- The Broomfield Enterprise

“The Boulder County Commissioners and Lafayette on Friday filed a lawsuit in Denver District Court against the Colorado Oil and Gas Conservation Commission and drilling operator 8North [Extraction] as defendants, alleging the state agency wrongly approved the company’s applications to drill in two areas of eastern Boulder County.”

“8North’s plans to drill 52 wells — including 20 within the town of Erie — from two separate surface sites were moved forward last month by the nine-member state commission with votes of 8-1 on each application.”

“But at the state commission hearing that ultimately approved the oil and gas projects, Boulder County officials contended 8North had failed to produce adequate evidence it owned all the mineral rights within the 4,000 acres it plans to tap through horizontal drilling.”

“That also is the basis of the lawsuit against the state commission.”

“The Blue Paintbrush site is 2,720 acres of mostly Boulder County-owned open space along East County Line Road between Quail and Mineral roads, while the Lupine site is 1,280 acres that includes land within Lafayette’s and Erie’s municipal borders just west of the Weld County line between Arapahoe and Baseline roads.”

“Minerals underneath both sites would be tapped from well pads located just outside Boulder County in the more oil-and-gas-friendly Weld County.”
