City Sues COGCC Over Crestone Spacing Unit Approval

 

On October 2, the City filed a complaint against the Colorado Oil and Gas Conservation Commission (COGCC) in Denver District Court over COGCC approval of the Crestone spacing unit for the Gotl Pad.  This lawsuit was announced on October 8 on the City’s Oil and Gas Webpage and will be item 12a under the Attorney’s Report at the October 9 Council Meeting.

The Gotl Pad is located east of I-25, approximately one mile north of E. 168th Avenue, and one quarter mile west of County Road 11.  The map of the Gotl Pad can be found here

The City summarizes its claims as follows:

  • “the COGCC exceeded its authority, abused its discretion, and denied Broomfield’s administrative, statutory, and due process rights.”
  • “the COGCC’s failure to consider public health, safety, welfare, and the environment was arbitrary, capricious, and not in accordance with state law.”

This lawsuit was filed by Special Counsel Phil Barber on behalf of Broomfield.
